Terms governing access to the Glavelle website and purchases of distinctive hand-painted ceramic artworks.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your use of https://www.glavelle.com and purchases from Glavelle. By accessing the site or submitting an order, you agree to these Terms, the Privacy Policy, Shipping Policy, and Returns & Damage Policy. If you do not agree, do not use the site or place an order.

You must be the age of legal majority in your place of residence, or act with the valid authorization of a parent or legal guardian, to enter into a purchase.

2. About the Artworks

Glavelle offers color-glaze, hand-painted, high-temperature-fired ceramic artworks. The firing process can cause glaze to flow and transform, creating natural variations in color, texture, crackle, and surface effects. Each artwork is distinctive, and no two pieces are exactly alike.

We make reasonable efforts to describe and photograph artworks accurately. Slight dimensional differences may arise from the handmade process, and colors may appear differently because of lighting, photography, or screen settings. These normal characteristics are not defects unless the artwork is materially inconsistent with its description or is structurally damaged.

3. Product Information and Availability

Product images, dimensions, materials, availability, and descriptions are provided for shopping guidance. Measurements are approximate unless stated otherwise. We may correct typographical, pricing, availability, or descriptive errors before accepting an order.

An item placed in a cart is not reserved. Because artwork availability may be limited, an order may become unavailable before dispatch. If we cannot fulfill an order, we will notify you and issue a full refund to the original payment method.

4. Prices, Shipping, Duties, and Taxes

Prices are shown in U.S. dollars. All Glavelle product prices include standard shipping to an accepted destination and the applicable import duties, customs charges, brokerage fees, and taxes that Glavelle has agreed to prepay for that shipment. No separate Glavelle shipping fee or tax amount should be added to the confirmed order total.

Your bank, card issuer, or payment provider may impose currency-conversion, international transaction, or other financial-service fees. Those charges are not collected by Glavelle and are not included in the product price.

5. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not by itself mean the order has been accepted. We may verify payment, address, inventory, and delivery eligibility. The order is accepted when we send a dispatch confirmation or otherwise expressly confirm acceptance.

We may refuse or cancel an order for legitimate reasons, including payment failure, suspected fraud, incorrect information, inventory error, legal restriction, or an unsupported delivery destination. If we cancel after payment and before fulfillment, we will refund the amount paid to the original payment method.

6. Payment

Available payment methods are displayed at checkout and are processed through Shopify and payment providers. You authorize the applicable provider and Glavelle to charge the confirmed order total. You represent that you are authorized to use the selected payment method and that the billing information is accurate.

7. Customer Information

You are responsible for providing accurate, complete, and current contact, billing, and delivery information. Notify us immediately if you discover an error. Changes are available only before dispatch and are not guaranteed. Responsibility for address errors is described in the Shipping Policy.

8. Cancellations, Delivery, Returns, and Refunds

A cancellation or order-change request must be made before dispatch and is effective only when confirmed by Glavelle. Processing, delivery, delays, lost packages, returns, damage, and refunds are governed by the Shipping Policy and Returns & Damage Policy, which form part of these Terms.

Risk of loss and ownership will pass as provided by applicable law. Nothing in these Terms removes any mandatory right you have when an order is not delivered or arrives damaged.

9. Permitted Use of the Site

You may use the site only for lawful personal shopping and information purposes. You must not interfere with site security or operation; introduce malicious code; scrape, copy, or harvest content by automated means without permission; impersonate another person; submit fraudulent orders; infringe intellectual property or privacy rights; or use the site in a way that violates applicable law.

10. Intellectual Property

The site and its text, photographs, artwork images, graphics, branding, layout, and other content are owned by or licensed to Glavelle and are protected by intellectual property laws. Purchasing a physical artwork transfers ownership of that physical item only. It does not transfer copyright or a right to reproduce, manufacture, distribute, license, mint, or commercially exploit the artwork or its image.

You may display the purchased physical artwork for personal purposes and may share ordinary personal photographs of it, provided the use is lawful and does not falsely imply sponsorship or authorization.

11. Reviews and Other Submitted Content

If the site allows you to submit a review, photograph, comment, or other content, you retain any rights you own and give Glavelle a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and adapt that content for operating and promoting the store, subject to applicable law and our Privacy Policy. Do not submit content you do not have permission to share.

We may moderate or remove content that is unlawful, misleading, abusive, infringing, irrelevant, or harmful to the site or others.

12. Third-Party Services and Links

Shopify, payment providers, carriers, and other third parties provide parts of the shopping and delivery experience under their own terms and privacy notices. The site may contain links to third-party websites. Glavelle does not control third-party content or practices and is not responsible for them except to the extent required by law.

13. Disclaimers

To the fullest extent permitted by law, the site is provided on an “as available” basis. We do not promise that every site function will be uninterrupted or error-free. These disclaimers do not apply to express product commitments in an accepted order or to warranties and consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Glavelle is not liable for indirect, incidental, special, or consequential loss arising from site use or an order when that loss was not reasonably foreseeable. We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, willful misconduct, or mandatory consumer remedies. Your statutory rights remain unaffected.

15. Governing Rules and Disputes

These Terms are governed by the laws that validly apply to Glavelle and the transaction, without depriving you of mandatory consumer protections available in your place of residence. Before starting formal proceedings, please contact glavellestudio@gmail.com so we can try to resolve the issue informally. Any unresolved dispute may be brought before a court or other forum with jurisdiction under applicable law.

These Terms do not require arbitration and do not waive any class, collective, representative, or statutory proceeding right.

16. General Terms

If a provision of these Terms is held unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated into them form the agreement concerning the site and orders, except for any additional written terms expressly accepted by both parties.

You may not transfer an order or your rights under these Terms in a manner that prejudices Glavelle without our consent, but this does not restrict rights that applicable law allows you to transfer. Glavelle may transfer its rights and obligations as part of a legitimate business reorganization or transfer, provided your rights are not reduced.

17. Changes to These Terms

We may update these Terms for future site use and future orders. The revised version will be posted with a new “Last updated” date. Changes do not retroactively alter an accepted order unless required by law or agreed with you.
